1. Acceptance of Terms
By accessing, creating an account, or purchasing a subscription to Med Qbank ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must stop using the Service immediately.
2. Medical Disclaimer
For Educational Purposes Only: Med Qbank is a study aid designed exclusively for medical students and healthcare professionals preparing for examinations such as the UKMLA AKT, PLAB, and Finals. It does not constitute medical advice, diagnosis, or treatment instructions.
No Clinical Reliance: While we strive for accuracy, medicine is an ever-changing field and content may not reflect the most current research or clinical guidelines. You assume full responsibility for your use of the information provided. Med Qbank disclaims all liability for errors, omissions, or actions taken based on this content. Do not use this Service to make clinical decisions for real patients.
3. User Accounts & Security
Registration: You agree to provide accurate, current, and complete information during registration and to keep it up to date.
Account Security: You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately via the support system if you suspect unauthorised access.
Single-Session Policy: Accounts are for individual, single-user use only. Our platform enforces one active session per account: signing in on a new device or browser will immediately and automatically terminate any existing session. Sharing login credentials, participating in "group buys", or any attempt to allow multiple people to access a single account is strictly prohibited and will result in immediate account termination without refund. We log IP addresses and session tokens and actively enforce this policy.
4. Subscriptions, Billing, and Cancellation
Recurring Billing: By starting a subscription, you authorise us (via our payment processor, Stripe) to charge your payment method on a recurring basis at the fee stated at checkout. Fees include VAT where applicable.
Cancellation: You may cancel your subscription at any time from your Profile page. Cancellation stops future billing but does not generate a refund for the current billing period. You will retain full access until the end of your paid cycle.
Digital Goods Waiver: By purchasing a subscription, you expressly request immediate access to digital content and acknowledge that, by receiving immediate access, you waive your statutory 14-day right of withdrawal under the Consumer Contracts Regulations 2013 (UK) or equivalent EU directives.
Referral Credits: Med Qbank operates a referral programme. If a user you referred subscribes, you may receive a credit of 30 free days added to your subscription. Referral rewards are subject to fraud checks (including IP-based verification) and are capped. We reserve the right to withhold or reverse credits if abuse or fraudulent activity is detected. Referral credits have no cash value and cannot be transferred.
Price Changes: We reserve the right to adjust pricing at any time. We will provide reasonable advance notice of any price changes via email.
5. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Scrape, spider, crawl, or use any automated means to access the Service or harvest data from it.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Service.
- Interfere with or damage the Service or its infrastructure, including through denial-of-service attacks, viruses, malicious code, or IP spoofing.
- Reproduce, redistribute, sell, sublicense, or otherwise exploit our questions, explanations, or any other proprietary content without written permission.
- Create, operate, or promote any competing product or service using content derived from the Service.
- Abuse the referral programme, including by creating fake accounts, self-referral schemes, or referring users from the same device or network to circumvent fraud detection.
6. Intellectual Property
The Service and all its original content (including but not limited to questions, explanations, code, design, and graphics) are and will remain the exclusive property of Med Qbank and its licensors. The Service is protected by copyright, trademark, and other laws of the United Kingdom and other jurisdictions. Nothing in these Terms transfers any intellectual property rights to you.
7. Limitation of Liability
To the fullest extent permitted by applicable law, Med Qbank, its affiliates, directors, employees, and suppliers shall not be liable for:
- Any indirect, incidental, special, consequential, or exemplary damages.
- Loss or damage resulting from unauthorised access, hacking, or tampering.
- Errors, inaccuracies, or omissions in content.
- Service interruptions, downtime, or data loss.
Liability Cap: Our total aggregate liability to you for any claims arising out of or relating to these Terms or your use of the Service shall not exceed the total amount you paid to us in the 12 months immediately preceding the claim.
8. Indemnification
You agree to defend, indemnify, and hold harmless Med Qbank and its licensors from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising from:
- Your use of or access to the Service;
- Your violation of any provision of these Terms; or
- Your violation of any third-party right, including intellectual property or privacy rights.
9. Service Availability
We do not guarantee that the Service will be available at all times. Maintenance, updates, or unforeseen technical issues may cause interruptions or errors. We are not liable for any loss or inconvenience caused by such interruptions. Med Qbank is a Progressive Web App (PWA); some static content and recently visited pages may be available offline via your browser's service worker cache, but core quiz and account features require an active internet connection.
10. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date above and, where appropriate, by email. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
