1. Acceptance of Terms

By accessing, creating an account, or purchasing a subscription to Med Qbank ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must explicitly stop using the Service.

2. Medical Disclaimer (Crucial)

For Educational Purposes Only: Med Qbank is a study aid designed exclusively for medical students and healthcare professionals preparing for examinations. It does NOT constitute medical advice, diagnosis, or treatment instructions.

No Reliance: While we strive for accuracy, medicine is an ever-changing field. We do not guarantee that our content reflects the most current research or clinical guidelines. You assume full responsibility for your use of the information. Med Qbank disclaims all liability for any errors, omissions, or actions taken based on this content. Do not use this Service to make clinical decisions for real patients.

3. User Accounts & Security

Registration: You agree to provide accurate, current, and complete information during the registration process.

Account Security: You are responsible for safeguarding your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

No Sharing: Accounts are for single-user, individual use only. Sharing login credentials, "group buys," or simultaneous logins on multiple devices to bypass payment is strictly prohibited. We monitor concurrent sessions and IP usage; violations will result in immediate termination without refund.

4. Subscriptions, Billing, and Cancellation

Recurring Billing: By starting a subscription, you authorize us (via our payment processor, Stripe) to charge your payment method the recurring fee stated at checkout. Fees include VAT where applicable.

Cancellation: You may cancel your subscription at any time via your Profile page. Cancellation stops future billing but does not generate a refund for the current billing period. You will retain access until the end of your current cycle.

Digital Goods Waiver: By purchasing a subscription, you expressly request immediate access to the digital content. You acknowledge that by gaining immediate access, you lose your statutory right to the 14-day cooling-off period (right of withdrawal) under the Consumer Contracts Regulations 2013 (UK) or similar EU directives.

Price Changes: We reserve the right to adjust pricing. Any price changes will take effect following email notice to you.

5. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any local, state, national, or international law.
  • Scrape, spider, or use automated means to access the Service or collect data.
  • Reverse engineer, decompile, or attempt to extract the source code of the software.
  • Interfere with or damage the Service, including (but not limited to) the use of viruses, cancel bots, Trojan horses, harmful code, flood pings, denial-of-service attacks, or packet or IP spoofing.
  • Redistribute, sell, or copy our questions, explanations, or proprietary content.

6. Intellectual Property

The Service and its original content (including but not limited to questions, explanations, code, design, and graphics) are and will remain the exclusive property of Med Qbank and its licensors. The Service is protected by copyright, trademark, and other laws of both the United Kingdom and foreign countries.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Med Qbank, its affiliates, agents, directors, employees, suppliers, or licensors be liable for:

  • Any indirect, punitive, incidental, special, consequential, or exemplary damages.
  • Damage, loss, or injury resulting from hacking, tampering, or other unauthorized access.
  • Errors, mistakes, or inaccuracies of content.

Liability Cap: Our total cumulative liability to you for any claims arising out of or relating to these Terms or your use of the Service shall not exceed the amount you paid to us in the 12 months immediately preceding the claim.

8. Indemnification

You agree to defend, indemnify, and hold harmless Med Qbank and its licensees and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Service.
  • Your violation of any term of these Terms.
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right.

9. Service Availability

We do not guarantee that the Service will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the Service, resulting in interruptions, delays, or errors. We are not liable for any loss caused by such interruptions.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
